What happens/what should one do when a company doesnt even have a persons w4\’s and takes taxes out?



My friend just got work at this gas station he put 12 hrs in @ $8xhr they pay every week and on payday they paid him with a personal business check with a dudes name and the name of another business below it which the manager offered to cash instantly at the gas station and ontop of that out of 96 dollars they took 16.50 off his check and said it was for taxes and when he asked where’s my paystub slip they said they have it over there or something of the sort. is that legal, cause I highly doubt it is. what should he do? should he sue call the police quit or what? he never even filled out a w4 until he asked to see the paystub off his check on his first payday, then they made him fill out one. how can they say they took taxes out if they didnt even tell him to fill out a w4 before he started work! so in essence he never claimed 1 on fed and one on state in order to get taxes taken out etc… i seriously think they robbin him just paying him by check out of a business pay out account an
…and its not only him working there he just started like 3 days ago they’ve got 3 other employee’s there that been working there for god knows how long and they been raping their pay as well telling them the same story and they don’t complain or know cause their illiterate indigent people in and from a bad part of town

    Call the IRS, immediately. Sounds like fraud.

    By law, they have to deduct for taxes whether or not they have a W4. I think they have to assume zero exemptions if they do not have a W4.
    The point that your friend did not get a pay stub bothers me and is potentially illegal. You could contact the IRS but you probably will get a better response from your state tax board. If your friend now has a a pay stub, make sure it has his name, social security number AND the employer ID numbers (fed and possibly state). There should be deductions for federal, state and local taxes along with FICA (Social Security) and medicare deductions. If it doesn’t contact your states tax board.

    The different business name is possible if the owner is operating under a different business name (known as a DBA, Doing Business As).
    There have been some illegal acts where an unscrupulous owner would deduct those taxes and not send it off the the government agencies. So have your friend hang onto the pay stubs and check it against the W2 form he should get after the end of the year. Also he should cash the check at a bank, preferably deposit the entire amount into his checking account so he has a valid audit trail.

    If he wants to keep this job, he should take his next check, make a copy of it and cash it at the bank where the account is.

    They have to deduct taxes - it’s the law. Now he has filled out a W-4 so they should be able to do this right.

    At the end of the year, they have to give him a W-2 showing everything they withheld. Your friend can then file his income taxes and get back anything that was overpaid.

    sounds like neighbor in a town close to me that was hiring people under the table, not paying in to their social security funds or any other taxes~!!!

    someone snitched, now his bar and property all around it is shut down until further investigation~!!!

    this guy cut down a tree on my property a while back, and the village board backed him, cause he is a Good Ol Boy Redneck Drinkin Buddy~!!!
