My fiancee\’s brother got 2 payday loans and closed his bank account. What will happen to him?



My fiancee’s brother got 2 payday loans. Before either of the checks could be cashed he closed his bank account. Now both of these places are calling our house wanting to talk to him, but he moved across the street (and he has no phone). We were wondering what would happen to him if he doesn’t pay these back. He seems to think that it will be 2 years before it catches up to him and that he won’t go to jail. We live in Ohio where check fraud is a misdemenor if the amount is below $500. His checks total $480. We have heard from some sources that he’ll go to jail, but others keeps saying he won’t. I want to know what will really happen.

    Nothing much…They will continue to search for him and put his DL (driver’s license or ID) an the bad check list and it may make it hard for him to cash or write checks in the future, but some can and will try to prosecute and maybe they might garnish his payroll checks in a very very late future!

    He could certainly be arrested. Do you think these places don’t know what to do when someone tries to avoid paying back the loan?? The amount of money isn’t important to them. They just have to make sure that if you try to stiff them, you don’t win.

    It’s not like he will be hard to find. Living across the street isn’t exactly Mexico.

    You should think about your own conscience and try to steer him straight. Tell him that you do not want to keep secrets about him and do not expect him to get away with it .

    Writing a check and then closing the account is a felony is many states. The payday loan companies are not in business to lose money. They will prosecute him in order to keep others in line.

    They will find him. And, it will be trouble.

    His best chance is to get the money and go and explain the mix up to the payday loan company and PAY THEM. And, never darken their door again. If he is not willing to do this, he deserves everything he gets.
